Terms of Service

1. Agreement

By downloading, installing, or using CodeStrain (the "Service"), you agree to these Terms of Service ("Terms"). The Service is provided by TOO HubLab ("HubLab.ai", "we", "us"), an Astana Hub resident entity registered in the Republic of Kazakhstan.

If you do not agree to these Terms, do not use the Service.

2. Description of Service

CodeStrain is a developer productivity and wellness tool that analyzes AI-assisted coding session metadata to provide strain scores, recovery metrics, ETA predictions, and break scheduling. The Service consists of:

• CodeStrain App: a macOS menu bar application
• CodeStrain CLI: an open-source command-line tool
• CodeStrain Cloud: optional server-side ML services for PRO/TEAM subscribers

3. Service Tiers

3.1 FREE Tier

• Fully local, no account required
• 7-day data retention
• Basic DRS score, break nudges, session tracking
• No server communication

3.2 PRO Tier ($9.99/month)

• Everything in FREE
• 90-day data retention with encrypted cloud sync
• ML-powered ETA predictions and strain forecasting
• Advanced analytics and trend reports

3.3 TEAM Tier ($7.99/seat/month)

• Everything in PRO
• Aggregate team dashboards (anonymized)
• Burnout risk alerts for team leads
• Admin controls and seat management

4. Subscriptions and Payment

Paid subscriptions are billed monthly through Stripe. By subscribing, you authorize recurring charges at the applicable rate. You may cancel at any time; cancellation takes effect at the end of the current billing period.

• We reserve the right to change prices with 30 days notice
• Refunds are handled on a case-by-case basis; contact support@codestrain.dev

5. Acceptable Use

You agree not to:

• Reverse-engineer, decompile, or disassemble the Service (except as permitted by applicable law)
• Use the Service to develop a competing product
• Attempt to access other users' data or bypass security measures
• Use the Service in any way that violates applicable laws or regulations
• Resell, sublicense, or redistribute the Service without written permission

6. Intellectual Property

The Service, including its design, algorithms, and documentation, is owned by TOO HubLab and protected by intellectual property laws. The CodeStrain CLI is released under an open-source license (see its repository for details).

Your data is yours. We claim no ownership over your coding session data, DRS scores, or any content on your device. See our Privacy Policy for details on what data is collected and how it is used.

7. Disclaimers

7.1 Not Medical or Professional Advice

CodeStrain provides estimates of developer strain and recovery based on coding activity patterns. The DRS score, readiness indicators, and break recommendations are informational tools, not medical or professional advice. Do not use CodeStrain as a substitute for professional health guidance.

7.2 "As Is" Service

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

7.3 Accuracy

DRS scores, ETA predictions, and strain estimates are derived from ML models and heuristics. They are approximations and may not reflect your actual physical or mental state. We do not guarantee the accuracy of any prediction or recommendation.

8. Limitation of Liability

To the maximum extent permitted by applicable law, TOO HubLab shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from or related to your use of the Service.

Our total aggregate liability for any claims arising from these Terms or the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms. Upon termination:

• Your local data remains on your device
• Server-side data is deleted within 30 days (or immediately upon request)
• You may export your data before termination via the app's export feature

10. Changes to Terms

We may update these Terms from time to time. Material changes will be communicated via email (for account holders) or in-app notice at least 30 days before taking effect. Continued use of the Service after changes constitute acceptance.

11. Governing Law

These Terms are governed by the laws of the Republic of Kazakhstan. Disputes shall be resolved through the Astana International Financial Centre (AIFC) Court, unless you are entitled to bring claims in your local jurisdiction under mandatory consumer protection laws.
